Terms And Conditions:

  1. By booking a music course with Grubser’s, the participant agrees to the following terms and conditions of Grubser’s Limited ("Grubser’s"):
  2. Grubser’s will make every effort to ensure each course is delivered as advertised. However, Grubser’s reserves the right to modify course content and/or materials as required in the interests of continuous course improvement. Grubser’s also reserves the right to make reasonable changes to course start dates, end dates, timetables, course location and/or teachers. Students will be given reasonably sufficient notice of any such changes where possible.
  3. A minimum of an enrolment fee as well as an instalment (as described for each particular course on Grubser’s website) is required to secure your place on all courses. (details of which are set forth on our website and the student handbook) in accordance with paragraph 10 below.
  4. Save in respect of courses booked and concluded in full over the telephone in which case students are statutorily entitled to cancel their participation on a course within 7 working days of payment, course fees and/or deposits are non refundable or transferable except in case of material breach by Grubser’s or in the absolute discretion of management.
  5. Save as otherwise prohibited by law, only students enrolled on the "flexible course" (as selected on the enrolment form and as detailed in the course handbook) may cancel or postpone lessons pursuant to paragraph 16 below.
  6. Non-attendance of classes does not constitute a cancellation or deferment of a course. Grubser’s reserves the right to charge reasonable administration fees for students who withdraw for reasons other than for material breach by Grubser’s or as in paragraph 7 below.
  7. In the case of unforeseen circumstances, or if insufficient student numbers are enrolled onto a course, Grubser’s reserves the right to cancel any course prior to commencement and in this case Gruber’s reserves the right to provide such enrolled students with a refund a refund in an amount which may be decided upon in Gruber’s absolute discretion.
  8. Grubser’s reserves the right to expel or suspend any student from all or part of their course in cases of unacceptable conduct.
  9. Grubser’s reserves the right to modify course prices from time to time (other than a course already contracted by the applicant); the website generally contains the most up to date price lists together with the required instalment payments.
  10. In addition to the enrolment fee described in paragraph 3 above, students are required to pay for each course on an instalment basis (details of which are set forth in respect of each course on Grubser’s website) and the first instalment for each course must be paid in full at least one week prior to the commencement date of the course start date, unless alternative arrangements are agreed in writing with Grubser’s beforehand. Grubser’s reserves the right to cancel the enrolment and allocate the place to another applicant in case of non-payment of course fees.
  11. If you do not make any payment due to Grubser’s by the due date for payment, Grubser’s may charge interest to you on the overdue amount at the rate of 4% a year above the base lending rate of Lloyds TSB from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with the overdue amount. In addition to the foregoing, Grubser’s reserves the right to add to any outstanding balance all reasonable costs incurred by Grubser’s in recovering such balances.
  12. Students who do not wish to renew their enrolment on to a course must notify Grubser’s in writing in accordance with the timetable below, otherwise students will be automatically enrolled on to the next scheduled course of the same name and of the same length and the first instalment for that particular course will be due one week in advance of the commencement date of such course (depending upon the previous method of payment).

  13. GRUBSER’S CANNOT ACCEPT RESPONSIBILITY OR LIABILITY FOR DEATH OR PERSONAL INJURIES EXCEPT FOR THOSE RESULTING FROM GRUBSER’S NEGLIGENCE OR BREACH OF DUTY. IN PARTICULAR, IT IS THE RESPONSIBILITY OF THE STUDENT TO ENSURE ADEQUATE EAR PROTECTION AT ALL TIMES PARTICULARLY WHEN USING AMPLIFICATION EQUIPMENT.
  14. GRUBSER’S SHALL NOT BE RESPONSIBLE FOR STUDENTS’ BELONGINGS, INCLUDING MUSICAL EQUIPMENT, WHILST ON GRUBSER’S PREMISES AND SO CANNOT IN THE ABSENCE OF ANY NEGLIGENCE OR BREACH OF DUTY BY GRUBSER’S OR ITS SERVANTS AND AGENTS BE HELD LIABLE FOR LOSS, DAMAGE OR THEFT OF SAID BELONGINGS.
  15. GRUBSER’S SHALL NOT BE LIABLE TO ENROLLED STUDENTS FOR LOSS OF PROFIT OR FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL LOSS OR DAMAGE OF ANY KIND. ANY OTHER LIABILITY OF GRUBSER’S TO STUDENTS UNDER OR IN CONNECTION WITH THE PROVISION OF A COURSE (OTHER THAN LIABILITY FOR DEATH OR PERSONAL INJURY FROM GRUBSER’S NEGLIGENCE OR BREACH OF DUTY) SHALL IN NO EVENT EXCEED THE FEES PAYABLE IN RESPECT OF SUCH COURSE.
  16. In addition to these terms and conditions, students agree to abide by policies and procedures as set out in the course student handbook and/or via notices displayed at Grubser’s premises from time to time.
  17. Students will be held responsible for any loss, theft or damage to the Grubser’s property however caused by them and will indemnify Grubser’s against any resulting liabilities and expenses.
  18. Grubser’s will not be liable or responsible for any failure to perform, or delay in performance of, any of Grubser’s obligations under these terms that is caused by events outside Grubser’s reasonable control which shall include any act, event, non-occurrence, omission or accident beyond Grubser’s reasonable control including, in particular (without limitation), the following:

    (a) strikes, lock-outs or other industrial action; or
    (b) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; or
    (c) fire, explosion, storm, flood, earthquake, subsidence, epidemic (including, without limitation, swine flu) or other natural disaster; or
    (d) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; or
    (e) impossibility of the use of public or private telecommunications networks (each a "Force Majeure Event").

    Grubser’s obligations under these terms and conditions are suspended for the period that the Force Majeure Event continues, and Grubser’s will have an extension of time to perform these obligations for the duration of that period. Grubser’s will take reasonable steps to bring the Force Majeure Event to a close or to find a solution by which Grubser’s obligations under these terms and conditions can be performed despite the Force Majeure Event.
  19. If any word/s, phrase/s or expression/s infringe(s) the Unfair Terms in Consumer Contracts Regulations 1999, the Consumer Protection from Unfair Trading Regulations 2008, the Consumer Protection (Distance Selling) Regulations 2000 or any other consumer protection laws they shall be treated as severable and shall be disregarded only so far as necessary and such other words shall be excluded or added as shall make sense of what remains.
  20. We reserve the right to set off any sums due to Grubser’s from students against any sums due to students from Grubser’s.
  21. These terms and conditions reflect the entire agreement between us and supersede all other contracts and representations that may have been made prior to this agreement. Any variation, amendment or alteration to this agreement (including for the avoidance of doubt, the enrolment form) must be in writing and signed by one of duly authorised representatives.
